Booking T&Cs

Agreement Definitions:

– “the website” refers to Savannah Expeditions’ website, savannahexpeditions.com.au.

– The Booker is the client responsible for the booking payment.

– The Event pertains to the scheduled event, for which the Booker is making payment.

– The Booking Group includes all passengers involved in the Booking or Charter.

– Booking schedule or event schedule refers to the time and location of the event outlined in the order confirmation email sent to the Booker. This schedule confirms the date, time, and departure location, along with contact details for the event, private charter, or venue hire agreement.

– Master denotes the qualified individual in charge of the booked vessel.

– An agreement is established between the Booker and Savannah Expeditions upon completion of a booking transaction. This agreement verifies that the Booker has acknowledged all ensuing terms and conditions.

Payment:

Payments are processed via the payment options specified in the charter agreement for your booking.

The Booker is liable for any costs resulting from damage caused by any member of the Booking Group.

Right Of Refusal:

Savannah Expeditions retains the right to decline or terminate a booking if the Booker fails to adhere to these terms and conditions.

Cancellation By The Booker And Refunds:

A no-refund policy applies to all cancellations made within 90 days of the charter date.

Should the charter be canceled in writing more than 60 days prior to the charter date, the option for postponement or credit of the charter for up to 12 months can be arranged.

A 100% cancellation fee will be applicable if the charter is canceled within 60 days of the charter date.

Cancellation By Savannah Expeditions:

Savannah Expeditions reserves the right to cancel and reschedule bookings due to weather conditions, safety concerns, vessel inoperability, or any other reason deemed necessary by the Master. In such instances, Savannah Expeditions may provide a suitable alternative vessel or charter date agreeable to both parties.

Responsible Service Of Alcohol:

Savannah Expeditions operates under the Responsible Service of Alcohol Act and reserves the right to refuse service to excessively intoxicated passengers.

Vessels Course:

The Booker acknowledges that the Master has sole discretion to take any action deemed necessary to safeguard the safety, welfare, and good order of the vessel. 

Weather Conditions:

The Booker agrees that all Charters will proceed regardless of weather conditions unless determined unsafe by the Master on the day of the charter.

Shoes:

Prior to boarding, all shoes will be collected and stored on board. Shoes will be made available for shore excursions and final disembarkation.

Smoking:

Savannah Expeditions strictly prohibits smoking on or inside the vessel at any time to prevent damage caused by ash and embers.

COVID-19 Safety:

Savannah Expeditions prioritizes COVID-19 safety for the comfort and safety of all guests. Any member of the Booking Group who is unwell, exhibits COVID-related symptoms, or is awaiting COVID test results is urged to refrain from attending and to arrange an alternative charter date.

In the event that COVID restrictions aVect Savannah Expedition’s ability to complete the charter, the charterer is entitled to a postponement with full credit or a refund.

Safety:

The Booker agrees to attentively listen to safety briefings, act responsibly, refrain from causing damage, and comply with all directives issued by the Master and crew.

Limited Liability:

By booking, the liability of Savannah Expeditions, its agents, employees, and subcontractors is acknowledged to be limited in accordance with the Limitations of Liabilities and Maritime Claims Act 1989 (Cth). Any claims for loss or damage must be reported in writing within 7 days of the Charter, with any legal action to be initiated within 365 days of the Charter date.

Indemnity:

The Booker agrees to indemnify and hold harmless Savannah Expeditions, its agents, employees, and subcontractors from any losses, claims, actions, costs, expenses, fees, damages, fines, or liabilities resulting from any negligent act or omission by the Booker or members of the Booking Group.

Risk:

The Booker acknowledges the inherent risks and dangers associated with being aboard any vessel. All passengers in the Booking Group participate in the event at their own risk.

Jurisdiction:

This agreement is governed by the laws of Queensland, and both parties agree to submit to the jurisdiction of the Courts of Queensland in relation to any disputes.

Acceptance:

By completing the website checkout, confirming acceptance of the terms and conditions, and making at least the deposit payment, the Booker consents to be bound by these Terms and Conditions. The Booker further acknowledges having read and comprehended these Terms and Conditions and agrees to convey them to the Booking Group.
